1. App Description

LessSmoke is a visual smoking self-tracking and wellness application. It provides calendar maps, progress insights, reminders, and optional social encouragement to support users who want to understand and reduce smoking.

2. Premium Purchases

LessSmoke Premium Plans

• Weekly Premium: Auto-renewable weekly subscription
• Monthly Premium: Existing monthly subscriptions remain supported
• Yearly Premium: Auto-renewable yearly subscription with a 3-day free trial for eligible new subscribers, followed by the displayed annual price unless canceled
• Lifetime Premium: One-time, non-consumable purchase that does not renew
• Price: The App Store displays the final localized price and trial eligibility for your country or region before purchase
• Features: Home Screen and Lock Screen widgets, viewing and editing every past day in the calendar, and the year map. Logging today stays free every day.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use LessSmoke for your personal, non-commercial use, subject to these Terms of Use.

4. User Responsibilities

• You must be at least 18 years old to use this app
• You are responsible for maintaining the confidentiality of your account
• You agree not to misuse the app or interfere with its operation
• You understand that this app is a tool to support quitting smoking and should not replace professional medical advice

5. Health Disclaimer

LessSmoke is designed as a support tool for quitting smoking. It is not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding smoking cessation or any medical condition.

6. Intellectual Property

All content, features, and functionality of LessSmoke, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by us and are protected by copyright, trademark, and other intellectual property laws.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the app, to understand our practices.

8. Prohibited Uses

You may not:

• Use the app for any unlawful purpose or to solicit others to engage in unlawful acts
• Violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others
• Submit false or misleading information
• Upload viruses or other malicious code
• Attempt to gain unauthorized access to the app or its related systems

9. Termination

We may terminate or suspend your account and bar access to the app immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms of Use.

10. Refunds and Cancellations

All purchases are processed through the Apple App Store. Refund requests must be made through Apple's standard refund process. We do not process refunds directly. To cancel your subscription, you must do so through your Apple ID account settings at least 24 hours before your subscription renews.

11. Limitation of Liability

To the fullest extent permitted by law, LessSmoke and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

12. Changes to Terms

We reserve the right to update these Terms of Use at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms of Use. Your continued use of the app after any such changes constitutes your acceptance of the new Terms of Use.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the app developer is located, without regard to conflict of law provisions.

14. Apple App Store Requirements

If you download the app from the Apple App Store, you acknowledge and agree that:

• These Terms of Use are between you and LessSmoke, not Apple
• Apple is not responsible for the app or its content
• Apple has no obligation to provide maintenance or support for the app
• If the app fails to conform to any applicable warranty, you may notify Apple and receive a refund of the purchase price
• Apple is not responsible for addressing any claims relating to the app or your use of it

By using LessSmoke, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
